CONgressional Fear of Constitutional Convention

FROM An Unhappy Summer for Liberty

At the root of the chaos in the Middle East and here at home are governments that respect no limits on their exercise of power. Public officials — who are supposed to be our public servants — routinely behave as if they are our masters. They reject the confines of the Constitution, they don’t believe that our rights are inalienable, and they fail to see the dangerous path down which they are leading us.

It is a path to an authoritarian America, predicted by the British writer George Orwell in his dark and terrifying novel “1984,” in which governmental power was fortified by fear at home and war abroad.

CONgressional Fear

Recently, a video announcement from the Hill stated that Sen. Tom Coburn, along with other so-called "conservatives", upon retirement from the Senate intends to work with States to convene a Constitutional Convention — thereby circumventing CONgress — to propose two Amendments.

Obviously, no member of CONgress, House or Senate, would sanction limits placed on how many terms they can "serve the People". Of course, for political theatre and the usual con game to defraud the People, CONgress would LOUDLY propose Term Limits and Balanced Budget (already) only to be defeated by one vote at midnight some night just like they vote for a pay raise.

By Article V of the Constitution, two-thirds of States may convene a Convention to amend the Constitution. Reportedly, Sen. Coburn wants a CONgressional Term Limits Amendment (the president is already limited to two four year terms (eight yrs.), the 22nd amendment, 2/27/1951) and a Balanced Budget Amendment, but Liberals want restrictions on campaign contributions — a violation of unlimited contributions the Supreme Court has ruled Free Speech. Campaign contributions are one method of freely supporting a candidate. After proposed Amendments are reviewed, modified and agreed, the proposed Amendments are presented to all States for ratification. Three-fourths of States must ratify the Amendments, and at that time the Amendments become part of the Constitution, the supreme law of the land.

Why Do We Need Term Limits?

John Adams said, “Without [term limits] every man in power becomes a ravenous beast of prey”. That being said, here are some of the reasons we believe our country needs Term Limits.

  1. Term Limits can help break the cycle of corruption in Congress. Case studies show that the longer an individual stays in office, the more likely they are to stop serving the public and begin serving their own interests.
  2. Term Limits will encourage regular citizens to run for office. Presently, there is a 94% re-election rate in the House and 83% in the Senate. Because of name recognition, and usually the advantage of money, it can be easy to stay in office. Without legitimate competition, what is the incentive for a member of Congress to serve the public? Furthermore, it is almost a lost cause for the average citizen to try to campaign against current members of Congress.
  3. Term Limits will break the power special interest groups have in Congress.
  4. Term Limits will force politicians to think about the impact of their legislation because they will be returning to their communities shortly to live under the laws they enacted.
  5. Term Limits will bring diversity of people and fresh ideas to Congress.

Term limits for lawmakers: when is enough, enough?

[Editor's Note: If you want to get rich, i.e. advance from a low paying government bureaucrat job on the local or state level, THEN GET ELECTED TO THE US CONGRESS (House or Senate). Once you're elected, it's easy to steal from your campaign contributions or the Congressional budget allocated to your seat and staff. You can go on a government-funded junket with 'lavishly' paid expenses. The list of ways to steal from the government while in office is inexhaustible. There are only a few Congressmen who left Congress just wealthy instead of a multi-millionaire. Of course, there are several who arrived in Congress as multi-millionaires and don't need to steal from the government.]

The video above shows Ted Cruz, a Texas Senator, feigning outrage at a new bill proposed by senate Democrats to ban various types of Free Speech. I think ALL members of CONgress would like such a bill to pass so that neither side has to endure the FREE SPEECH of citizens who very skillfuly criticize the buffoons in CONgress who have oppressed the American People with their tyrannical and politically motivated laws that fleece the American People and US Treasury. But would CONgress pass a bill that restricts 1st Amendment, free speech? Given meager opposition from the progressive, socialist press, and very little resistance or understanding of the Constitution by many Americans, I think it's possible. CONgress has passed SO MANY laws that limit and restrict, almost relegating the Constitution to history. Today, Supremes rely more on relevant case law and legal precedent than interpretation of the Constitution's restrictions on government and the general worldview of LIBERTY.

But, mostly, this bill is a Red Herring and MISDIRECTION! On 9/11/14, the bill was voted down in the Senate, 54-42.

While Cruz says that the senate should be considering more important issues like ISIS and illegal aliens crossing the border, I think that the fighting on the ground in Iraq should be done by the Iragi government (however inept), and the cause of the ISIS problem is the Syrian civil war and the original invasion of Iraq by the W administration. Americans have needlessly sacrificed TOO MUCH for bogus, political reasons. In regards to immigration, the Executive branch ALREADY has all of the law and regulations needed to settle the border problem. The "Democrats" just want more government dependents and voters.

I can't help but chuckle, even laugh out loud when I observe the transparent efforts of CONgress to instill fear in the People of changes to the Constitution because they fear losing the POWER (and money) they have over the People.

A Constitutional Convention MUST be supported by States if States ever want to get out from under the thumb of the feds crushing the freedom of the country.

I would prefer a FULL RESTORATION of AMERICA in a Constitutional Convention, but the fear of many government people and their supporters is the loss of power, our money, and the Federal Reserve's "rubber bucks".

10/23/14 FROM The Hill

A federal judge on Thursday ordered the IRS to detail under oath how some of former agency official Lois Lerner’s emails went missing, as well as any potential methods for recovering them.

Judge Emmet Sullivan of the U.S. District Court in Washington gave the Internal Revenue Service exactly a month — until Aug. 10 — to file a report, which he demanded as part of a lawsuit from a conservative watchdog, Judicial Watch, against the agency.

Judicial Watch is seeking a wide range of documents from the IRS, including Lerner’s emails, as part of a Freedom of Information Act request. It has complained that the IRS didn’t tell it that the agency couldn’t recover all of Lerner’s emails from 2009 to 2011.

Sullivan cast his ruling as a compromise, and a potential way for Judicial Watch to get answers without the court wading any deeper into the matter. Judicial Watch had asked the court to potentially compel IRS officials to testify about the lost emails, through a process called limited discovery.

[MORE: America was once a free country, but the Legislative-Executive-Judicial conspiratorial cabal elected to "represent" us has miserably failed (intentionally) to lawfully enforce the Constitution and has almost destroyed what was once our bastion of liberty for their personal gain instead of their oath to defend the CONSTITUTION! Since they have immunity and you can't impeach the entire CONgress for "high crimes and misdemeanors", WE live with voting for the least corrupt candidate(s) who (seemingly) sincerely propose to muster widespread agreement to restore liberty by significantly reducing the size of federal government to a weak, central government for defensive purposes only (without income tax). Unfortunately, many elected reps are induced and persuaded (by whatever means) into supporting the interests of very well-funded, power-wielding, small groups. Also, many voters cast their vote for a candidate who might enable a vicarious experience of power instead of a real experience of freedom in their life.]

FROM Project to RESTORE AMERICA

The FairTax is a consumption tax unilaterally applied to all Americans at the same rate. For businesses, payroll taxes would no longer exist. Our exports would include a heavy tax for overseas buyers purchasing our products, while our imports would be cheaper for us to purchase. I'm not sure how this would affect GDP, as more information is necessary.

According to the FairTax website, "Under the FairTax, every person living in the United States pays a sales tax on purchases of new goods and services, excluding necessities due to the prebate." The prebate gives every legal resident household an "advance refund" at the beginning of each month so that purchases made up to the poverty level are tax-free.

So a family of four making something like $50,000/year should not have to pay taxes, thus preventing an unfair burden on low-income families. Since the FairTax eliminates both federal and payroll taxes, you get to keep your gross pay amount of each paycheck earned.
